Abstract

The integration of artificial intelligence into our societies has been a fast-paced process which has had an impact in every aspect of human life. The development of this technology has opened several political and social discussions regarding the lack of understanding of AI functioning and the enormous risks it can prose, which Law must regulate.

In response to this concerns the European Union has been, since 2018, working on the AI horizon as a new study field and since 2020 has been developing a harmonized regulation on the matter as a priority of the Union. The EU objective is to create a common framework for all 27 member States based on ethical principles. This regulation -which will previsible be adopted on 2024- sets a milestone, as the first AI regulation in the world.

Along with the approval of this regulation there is a new legal and social challenge for the EU which must guarantee the protection of their citizens against an ever-evolving technology which developsfaster than Law does and which posts a specific danger to Fundamental Rights such as data protection, privacy, and freedom of speech and thought -essential to enable free and fair electoral processes- as well as to present numerous transformations for labor market.

The decisions which are being taking regarding this regulation are going to be essential for the future of democratic societies and for the rule of law and will have an impact in the European Union and its position in the international community and its relationships with third countries. The objective of this thesis is to study the risks presented by AI and how those risks impact the EU, to analyze the legal framework proposed by European organizations and how those proposals may impact in the position of the EU regarding Digital Governance and diplomatic relations to present proposals to improve the norm application with an emphasis on protecting Fundamental Rights.
